Urgent! The new version of EU battery regulations will be released

It will officially come into effect in Poland on August 18th!

The EPR compliance of Polish batteries has entered the countdown stage.

On August 18, 2025, the new version of the EU Battery Regulation (EU) 2023/1542 will officially come into effect in Poland.

For cross-border sellers, if they fail to comply by this date, they will face a series of serious consequences such as product removal from the platform, store restrictions, sales interruption, and damage to brand reputation.

The EU has a broad definition of "producer", and if you meet at least one of the following conditions, you are considered a producer and need to register under battery laws:

Cross border direct sales:Non EU domestic enterprises sell batteries or battery containing products directly to EU end consumers through e-commerce platforms. For example, a Chinese technology company selling Bluetooth earphones on Amazon Germany requires registration with the German Battery Law.

Local resale:Enterprises registered within the European Union resell batteries or battery containing products under their own brand. For example, a Dutch trading company that purchases Chinese batteries and sells them in the Netherlands with its own trademark must complete the registration under Dutch battery law.

Unscented resale:If the resold goods are not labeled with manufacturer information, the producer is also responsible.

First import:Companies that introduce battery products from other countries into the EU market for the first time need to register even if they do not sell directly.

Product delisting:Amazon, Allegro, eMAG and other platforms will force the removal of products without EPR numbers;

Decreased store traffic:The platform restricts traffic exposure and prohibits advertising placement;

Legal penalties:The Polish environmental department will issue a fine, with a maximum amount of 50000 Polish zlotys or calculated based on the weight of the product;

Losing pan European delivery eligibility:Battery products cannot enter the Polish warehouse, which affects the entire pan European logistics network;

Brand reputation loss:Consumer trust has declined, affecting subsequent conversions and repeat purchases.

1. Evaluate the scope of responsibility products:

Battery types: AA/AAA batteries, rechargeable batteries, button batteries, etc;

Products with batteries: mice, remote controls, speakers, power banks, etc;

2. Sign the commission agreement and authorization documents:

If it is a non EU enterprise, a representative must be authorized simultaneously;

3. Register for the BDO system;

4. Entrust compliant PRO organizations (such as ChinEuro to provide you with compliance services);

5. Declare annual sales weight and battery category;

6. Pay annual environmental protection fees (based on tonnage);

7. Submit the battery EPR number to the platform and complete the platform compliance upload.
