    《商标法（修订草案）》向社会公众征求意见，全文及重点都在这里了

    商标法第五次修订迎来新消息，12月27日中国人大网发布《商标法（修订草案）》征求意见，此次发布的《商标法（修订草案）》不同于2023年1月13日发布的《商标法（修订草案）征求意见稿》共101条，此次修订后的草案内容共计84条。

    此次征求意见期限为45日，自2025-12-27 至 2026-02-09。


    修改后的重点小结：

    1. 商标异议期三个月缩短至两个月；

    2. “被撤销、宣告无效或期满不续展”情形下的一年保护期，修改为“注销注册商标”的一年保护期；

    3. 划定恶意申请商标的具体情形，明确对应处罚金额；

    4. 对自行改变商标注册事项、以误导公众方式使用商标的行为，增设处罚金额；

    5. 新增集体商标、证明商标管理不规范的处罚条款；

    6. 确认驰名商标的途径

    此次商标法修订是一次系统性制度升级。修订草案针对恶意注册、商标囤积、侵权等突出问题完善商标注册管理和保护制度，对于我国从商标注册大国迈向商标品牌强国具有重要意义。
