澳大利亚商标的不良代理行为日益增多,已引起官方和律师的高度重视

澳大利亚知识产权局(IP Australia)2025 年[敏感词]至第三季度的商标申请量大幅增长,较 2024 年同期上升 20.8%。

其中,67% 为澳大利亚本土申请,33% 来自外国申请人。若对外国申请按国别进一步细分,会发现一组极具参考价值的数据:中国申请人的申请量增幅为显著,较去年飙升 63%,占全年申请总量的 18.7%,其规模远超其他所有海外[敏感词]申请量的总和。根据以往的经验来看,此类申请中相当一部分(虽非全部)与境外主体的品牌标识高度重合,中国申请人提交此类申请的目的多为在澳大利亚主张商标所有权,进而纳入亚马逊品牌注册体系(Amazon Brand Registry)。受此影响,商标异议案件与撤销申请的数量也随之大幅增加。



为此,我们也和当地的代理律师进行了沟通,根据律师的反馈,我们整理出以下律师常态化处理的问题:

①公共记录中登记有大量所谓 “澳大利亚服务地址(AFS)代理”—— 因申请需提供澳大利亚或新西兰境内地址,但其中许多代理被澳大利亚知识产权局标记为 “服务地址争议” 状态,这意味着相关申请或代理主体不具备合法性;

②许多 “存量注册商标” 也被标记为 “服务地址争议” 或类似异常状态;

③部分未决商标申请并非维持相应状态留存于商标注册簿,而是从注册簿中无故消失。

后一点尤为反常 —— 律师在通过主动监测准备提起异议的过程中,曾亲身遭遇过此类情况。



通过行业监测及处理多起涉及此类申请的异议与撤销案件,律师还发现了以下特殊行为:

①申请人会试图为其商标申请进行抗辩,而非在申请明显存在恶意的情况下选择主动放弃(后者本应是符合逻辑的选择);

②注册商标权人即便显然无诚实用途该商标的善意,仍会针对目标商标的撤销申请提起异议;

③申请人及注册商标权人提交的声明与证据格式存在严重瑕疵,部分案件据称有律师参与协助。我们曾处理过一起案件,声明人自称律师,但经核查未发现任何佐证材料,其提交的声明格式也与律师执业规范不符;

④未经授权的个人擅自接管大量澳大利亚商标,并自行任命自己为新的商标代理人,且未获得商标权人的任何授权。



若此趋势持续,所有品牌所有人均需高度重视:商标使用格局(尤其是侵权行为的表现形式)正发生显著变化,这说明商标申请量的大幅增长已引起澳大利亚知识产权局官方的重视并已然采取的一系列措施来进行缓解。

同时,这也使得企业及所有商标权人配备专业且强有力的法律团队变得更为关键。对于已在澳大利亚开展贸易或有意进入澳大利亚市场的外国品牌而言,这一点尤为重要。因为此类品牌往往是中国申请人提交相关商标申请的主要目标。而这一需求不仅体现在商标初始注册及续展阶段,更贯穿于商标监测服务的全过程,以便及时发现潜在侵权行为及恶意申请。
