    【美国专利申请常见问题】发明专利授权后，需缴纳几次维护费？分别在授权后的什么时间点缴纳

    依据美国专利商标局（USPTO）的规定，美国发明专利授权后需缴纳3 次维护费，以此维持自申请日起 20 年的专利有效性。


    Part.1

    重要时间节点

    [敏感词]次维护费：可在专利授权后 3 年至 3 年 6 个月内缴纳，这是无滞纳金的缴费时段；若逾期，可在授权后 3 年 6 个月至 4 年的宽限期内补缴，但需额外支付滞纳金。

    第二次维护费：无滞纳金缴费时段为授权后 7 年至 7 年 6 个月；宽限期为授权后 7 年 6 个月至 8 年，逾期补缴需缴纳滞纳金。

    第三次维护费：无滞纳金缴费需在授权后 11 年至 11 年 6 个月内完成；宽限期是授权后 11 年 6 个月至 12 年，此阶段补缴同样要支付滞纳金。

    关键注意事项

    一是USPTO 不会主动发送维护费缴纳通知，仅会在滞纳期内提醒代理机构相关缴费事宜；

    二是若宽限期届满仍未缴纳费用，专利将终止，但如果能证明延迟缴费是非故意导致的，可提交[敏感词]书并补缴费用，申请恢复专利效力。
