The examination process for invention patent applications in Greece is completely different from that in China. Greek invention patents do not require substantive examination, but for invention patents, applicants are required to submit a search request and make corresponding search reports based on it. The applicant must pay the search report fee within 4 months from the date of application. Within 4 months after the application date, if the fee for the search report has been paid and the materials are complete, the Industrial Property Office will check its novelty and creativity based on the search report. If the material is incomplete, it shall be deemed withdrawn. If the materials are complete but the search report fee has not been paid, and the application meets the requirements of a utility model patent, it can be converted into a utility model patent application. If the applicant requests priority, they must submit proof of priority within 16 months after the priority date.
The Greek Industrial Property Organization will issue a search report within 12 months from the date of application. Within 3 months of receiving the search report, the applicant or patent agent may provide comments, and the Greek Industrial Property Organization will make the final search report. If no comments are provided, the initial search report will be the final search report.
Greek utility model patent applications only need to undergo formal examination, and can be granted after passing the formal examination.
To apply for a design patent in Greece, the required application documents include an application form, design drawings or photographs, and a brief explanation. If the application materials are incomplete, supplementary materials can be submitted within four months from the application date, as long as the materials are complete and meet the formal requirements, and there is no novelty examination. If it does not meet the formal requirements, it shall be deemed as a withdrawal of the application.
