The Constitution, Civil Code, Invention Law, Trademark Law, and Invention Patent Law of Tajikistan all have provisions for the protection of intellectual property rights. Tajikistan joined the World Intellectual Property Organization (WIPO) in 1991 and has participated in a series of international and regional intellectual property protection systems. It has successively issued the Industrial Design Law and the Invention Patent Law to protect intellectual property rights, forming a relatively complete intellectual property legal system.

Tajikistan adopts the Nice classification system and accepts multiple types of applications. The elements that can be registered as trademarks include: text, name, graphics, three-dimensional identification, color combination, slogan, sound, appearance, etc. Among them, the color combination needs to meet specific requirements.

Duration
The trademark is valid for 10 years from the date of application; Renewal can be applied within 12 months before the expiration date, with a grace period of 6 months and a validity period of 10 years.
If a trademark has not been used for three consecutive years, an application for revocation can be filed.
Tajikistan is a party to international intellectual property treaties such as the TRIPS Agreement, Paris Convention, Nice Agreement, and WIPO Convention, and is also a member of the Madrid Agreement and Madrid Protocol. Therefore, trademark registration in Tajikistan can be handled through "single country registration" or "Madrid international registration".
Submit trademark application documents;
The examiner will conduct a formal and substantive examination of the application to confirm whether the application documents are complete and whether the applied trademark meets the basic registration requirements; If the review fails, a rejection notice will be issued and a response will be required within the specified time;
The trademark examination process in Tajikistan is divided into two stages:
Phase 1: Formal review. At this stage, the examiner primarily examines whether the content of the trademark application complies with legal provisions. The review period is one month.
Second stage: substantive examination. The review will mainly be conducted after the formal review and within 12 months from the date of application. Legal entities and individuals engaged in business activities in Tajikistan are eligible to submit trademark registration applications. Foreign legal entities or their representatives must submit trademark applications through authorized Tajikistan agents. The competent authority responsible for trademark registration affairs in Tajikistan is the National Patent Information Center (NPIC) under the Ministry of Economic Development and Trade.
NPIC will make a decision on the registration or rejection of a trademark application based on the results of expert review. Once the formal examination is passed, the intellectual property agency will publish the trademark application information in the Official Gazette.
After passing the examination, the trademark will be approved for registration and a trademark registration certificate will be issued to the applicant;
According to the decision of trademark registration, NPIC will register the trademark in the country's trademark register within one month and issue a trademark certificate within one month after the trademark is included in the register.
First issue the certificate, then make an announcement, but there is no objection period.

The trademark registration application should be submitted in hard copy form and include the following content1. Trademark registration application documents, including the applicant's name and place of residence;
2. Trademark name;
3. A list of goods grouped according to the International Standard Classification of Goods and Services (ICGS) applicable to trademark registration;
4. The description of the applied trademark must be submitted in Tajik or Russian and must be signed by the applicant or their representative. -
The trademark registration application should also include the following supplementary content1. Confirmation of full payment of relevant fees; Guidelines for the use of collective trademarks (if submitting an application for a collective trademark);
2. Trademark Agency Authorization Letter.
