the protective principle
The principle of prior application is that Taiwan's Trademark Law mainly provides protection for registered trademarks.
Due to the independent trademark laws and regulations in Taiwan, even trademarks that have already been registered in mainland China need to be re registered in Taiwan before they can be protected. And Taiwan has not joined the Madrid System, so registration cannot be done through the Madrid Agreement, and registration can only be directly applied to the Taiwan Trademark Office.
Taiwan trademark registration requires the applicant or their agent to go to the Taiwan Intellectual Property Office to handle the relevant application procedures and submit the required documents for the application.
After receiving a trademark registration application in Taiwan, the Taiwan Intellectual Property Office will review whether the application documents comply with regulations and are complete. After the review is approved, the application will also be examined whether it meets the basic registration requirements and whether it violates relevant laws and regulations in Taiwan.
After examination, the Taiwan trademark registration application that is considered eligible for registration will be published on the official announcement platform in Taiwan for public evaluation, and anyone can raise objections to the application.
According to the announcement, Taiwan trademark registrations with no objections or invalid objections will be approved for registration by the Taiwan Intellectual Property Office, and a Taiwan trademark registration certificate will be issued to the applicant.
