There is currently no written trademark legal system in Myanmar, and trademark protection is mainly achieved through filing at the registration office and issuing warning notices in local newspapers and magazines. In recent years, there have been rumors that Myanmar will implement a new Trademark Law, but it has not been implemented yet. After years of preparation, the implementation of Myanmar's new Trademark Law has finally taken a big step forward. Following the release of Notice No. 63/2020 by the Myanmar Ministry of Commerce on August 28, 2020, which guided the implementation of the "6-month transition period", it was announced that the new Myanmar Intellectual Property Office would start accepting new applications for the "transition period" from October 1, 2020, and it is expected that this trial operation will last for at least 6 months until the "grand opening". After the end of the "transition period", all officially applied trademarks will be closer to international practices and undergo formal examination, substantive examination, announcement, opposition, and registration stages. At present, the Myanmar Intellectual Property Office is responsible for managing trademark affairs.

objection to a trademark
The objection period is 60 days from the date of announcement, and any interested party or prior right holder may raise objections. The main reasons for raising objections are:
1. Conflict with prior trademarks, such as owning a prior registered trademark;
2. The trademark lacks distinctiveness;
3. The trademark has adverse effects;
4. Malicious registration;
5. Conflict with other prior rights, such as trade name rights, design rights, copyright, etc. -
Trademark revocation
For a registered trademark, if any third party applies for revocation of the trademark, the trademark needs to be revoked through official procedures. Revoking the program requires the following conditions to be met:
(1) The reason for revocation must be 'clear violation of trademark law';
(2) The reason for revocation must be 'not used for three consecutive years';
(3) The applicant must submit it within the prescribed time;
(4) For the preliminary ruling, the Trademark Office will not issue a written notice to the applicant, and the applicant has 30 days to respond. -
Trademark classification
Through the interpretation of the new Trademark Law, Myanmar adopts the Nice Classification 11th edition for the description of goods and services and accepts applications for multiple categories. The elements that can be registered as trademarks in Myanmar include: text, name, graphics, color, letters, numbers, etc.

1. In fact, trademarks in Myanmar belong to a common law concept of protection. There is no legal system for relative registration.
2. Myanmar is actually a registration system, not an exclusive right granted by government departments.
3. Trademarks can be registered by issuing a declaration of ownership to the Myanmar Registration Office to protect their legitimate rights and interests.
4. The declaration must include the name, signature of the individual registering the Myanmar trademark, etc. (The declaration of ownership is only unilateral by the declaring party)
5. When registering, authentication from local officials, notaries, or judicial officials is usually required. (Ownership statement is not the final proof of exclusive trademark rights)
6. In the process of criminal or civil litigation, the parties may issue such a registration certificate;
7. Notarization certificate required for trademark registration in Myanmar.
Due to Myanmar's lack of formal accession to the Madrid Agreement or Madrid Protocol, trademark registration can only be processed through "single country registration".
1. Registered trademark categories: Industrial, design, sales, service, and production trademarks, with the scope of registration including names of goods and services;
2. Documents for submitting the application: The documents required for applying for a trademark include: trademark design, applicant's name and address;
3. Registration time: It takes approximately 3 months to complete after submitting the application;
4. Trademark examination process: After receiving the trademark registration application submitted by the applicant, the Myanmar Trademark Office will conduct an examination of the trademark, which includes:
① Whether there is a conflict with prior rights;
② Is there any situation that does not comply with legal regulations;
③ Whether it has significance;
Announcement and Objection: The opposition period is 6 months after registration. Anyone who has objections to a registered trademark can submit them to the Myanmar Trademark Office, which will decide whether to accept the opposition application. If not accepted, the application will be rejected.
After the applicant submits an application to the Myanmar Trademark Office, they will receive a notice of application acceptance issued by the Myanmar Trademark Office. The applicant is required to provide the required materials according to the requirements of the notice, including the application form, trademark design, power of attorney, etc. After the materials are qualified, the Myanmar Trademark Office will conduct a formal examination of the trademark. After passing the examination, the trademark will be entered into the Myanmar database.
1. After the applicant submits the application, the Myanmar Ministry of Intellectual Property and Technology Resources will conduct a formal examination within one month.
2. If the application is approved, the Myanmar Ministry of Intellectual Property and Technology Resources will issue a notice informing the applicant of the result of the trademark registration application.
3. If the applicant is not satisfied with the trademark registration result, they may apply for a review to the Myanmar Ministry of Intellectual Property and Science and Technology Resources.
4. If there are still objections to the review results, an appeal can be made to the Supreme Court of Myanmar.
1. After the trademark application is submitted, the Trademark Office will announce the application content on its official website and publish it in the "Trademark Announcement".
2. If someone raises an objection to the trademark registration, the objection period is 6 months. During this period, the applicant may raise objections by submitting defense opinions to the Trademark Office. If the objection is valid, the trademark application will be rejected; If the objection is not valid, the trademark registration will be approved.
3. Anyone can object to the trademark registration that has been announced. The applicant shall defend the application within 6 months from the date of receiving the notice of trademark registration rejection.
According to the Myanmar Trademark Law, when applying for trademark registration, one must submit the trademark design, the applicant's name, address, and the goods or services being registered. If the trademark application does not meet the above requirements, the Myanmar Trademark Office will reject the registration application for the trademark. If the applicant is a natural person, their name and address must be consistent with the name and address on their business license. In addition, the Myanmar Trademark Office does not accept trademark registration applications submitted by natural or legal persons in their name.
If the applicant does not reside in Myanmar, they must entrust a specialized agent in their home country to handle the matter. The basic materials required for trademark application are:
1. Trademark design;
2. Specific categories and product/service items;
3. Name and address of the applicant;
4. Trademark description;
If priority is declared, priority proof documents and corresponding English translations must be provided.
