The acquisition of trademark rights in Lebanon follows the principle of the prior application trademark system, which also recognizes prior use trademark rights in Lebanon.
The competent authority for trademarks in Lebanon currently accepts trademark registration applications for commodity trademarks, color trademarks, collective trademarks, and service trademarks.
Lebanon adopts the trademark classification method of the International Classification of Goods and Services.
Because Lebanon has not joined the Madrid Agreement or the Madrid Protocol, it is not considered a member state of Madrid. Therefore, if a Lebanese trademark needs to be registered, it can only be processed through a single method - through the local trademark registration authority in Lebanon.
1. The trademark is not a government symbol such as the national flag;
2. The company's business scope must be in Lebanon;
Registration validity period: 15 years, calculated from the date of application.
Trademark renewal: Each renewal is valid for 15 years. The application for renewal can be submitted before the expiration date or within the 3-month grace period after the expiration date.
1. Application form: Relevant information of the applicant, as well as information on the registered product/service category;
2. Applicant's main proof documents: If it is an individual application, the applicant's identity document or passport copy needs to be provided; If it is an enterprise application, a copy of the business license of the applying enterprise must be provided;
3. Trademark design: Clear and visible, electronic version is also required;
4. Application for power of attorney: It needs to be notarized and is required when entrusting an agent.
In Lebanon, the trademark registration process consists of three steps: examination, announcement, and registration.
After receiving a trademark application from a company, the Lebanese authorities will conduct formal and substantive examinations (including examination of relative and absolute reasons). Formal examination mainly examines whether the application requirements and classification information comply with regulations, while substantive examination includes examination of the distinctiveness of the trademark, whether it violates the prohibition and prohibition clauses, and whether it conflicts with prior trademarks.
After the trademark application is reviewed and approved, if there are no reasons for rejection, the trademark application will be approved for registration and announced. If everything goes smoothly, it takes about 2 to 3 months to register a trademark in Lebanon. If there are any trademark objections or other issues along the way, the time will be correspondingly extended.
