A request for substantive examination may be filed within 18 months from the date of patent application or within 6 months from the date of filing the request for substantive examination. This program is an early review process, and if the application documents are not submitted within the specified time, the application may be considered withdrawn.
From the date of application for a design patent, a design objection procedure can be initiated within 18 months. This program is aimed at raising objections to design patents already registered in the United Arab Emirates.
Normally, the applicant has 30 days to consider whether to continue the examination process. If there are no objections, the patent will be granted; If there are objections, a response or modification is required. If there are still objections after the response, the patent will be withdrawn. If the applicant fails to provide substantive opinions or fails to respond to the examination request within the prescribed time, the application will be deemed withdrawn.
The fees required to be paid in the review process include: application fee, review fee, registration fee, annual fee, etc.
After authorization, the patent applicant has the obligation to maintain the patent during its validity period to ensure the validity of their rights. In any case, if the patentee fails to pay the annual fee on time or fails to pay any fees, the patent right will automatically expire upon the expiration of the term. In addition, if the patentee raises any objection or lawsuit against their rights, they shall submit it in writing within 3 months from the date of the objection or lawsuit.
In this case, if the applicant is unwilling to continue using the patent, the patent will be considered automatically terminated. At the same time, the Patent Office will also issue a notice requiring the patentee to pay the annual fee or fee within one month from the date of receipt of the notice.
