Kuwait patent applications are divided into two forms: formal examination and substantive examination.
Formal examination: All documents related to Kuwaiti patent applications must be notarized and authenticated by the Kuwaiti consulate; Applicants for patents in the name of a company must also provide a certified certificate of company registration or an excerpt from the business register; If the applicant is not the inventor, the original notarized transfer certificate must be provided;
Substantive examination: Currently, there is a serious backlog of patent application cases in Kuwait, and substantive examination requests cannot be submitted simultaneously with new applications. The entire examination process will involve approximately 1-3 examination opinions; Search reports or biased examination opinions from other countries around the world will be helpful in obtaining authorization for patent applications in Kuwait.

(1) Deadline requirement: 12 months from the earliest priority date, and 30 months from the earliest priority date for PCT to enter the Kuwait national phase. Priority restoration on the grounds of "due diligence" and "non intent" is acceptable.

(3) It can be submitted in English, but an Arabic translation must be provided within 3 months from the application date.
(2) Authorization and annual fee
Kuwait has an authorization fee, which is paid annually from the second year after the patent application date. The annual fee is paid from January 1st to March 31st each year. If this deadline is missed, it can be extended to June 30th after paying the late fee.
