Formal examination and substantive examination
1. The name and address of the applicant;
2. Name and address of the inventor;
3. Complete set of application documents: including claims, specification, abstract, and drawings;
If priority is requested, a certified copy of the priority document must be provided (priority requests can be made within 2 months from the application date, and documents must be submitted within 6 months);
5. The signed authorization letter must indicate the name and position of the signatory (which can be submitted within 2 months from the submission date), and does not require authentication or notarization.
After submitting the application, it will undergo formal examination. After passing the formal examination, a temporary patent authorization decision will be issued. The validity period of the temporary patent is 5 years, which can be extended for 3 years. The request for substantive examination can be submitted within 3 years from the date of publication of the provisional decision on patent grant and the date of application. If the patent application meets the requirements of protectiveness, the patent right shall be granted. The average cycle for obtaining patent rights in Kazakhstan is about 2-5 years.
