1. Invention Patent
After submitting the application documents and paying the application fee for an Iranian invention patent, a preliminary examination will be conducted, and the Industrial Property Office will publish the patent application documents 18 months from the date of application. After passing the preliminary examination, the invention patent application will undergo substantive examination, and once the substantive examination is approved, the authorization will be announced.
Iranian invention patents require payment of at least one year's patent annual fee at the time of application. The annual fee can be paid in a lump sum or annually upon authorization; If you make a payment for five years, you will receive a 5% discount. If you make a payment for ten years, you will receive a 10% discount. If you make a payment for fifteen years, you will receive a 15% discount. If you make a payment for twenty years, you will receive a 20% discount. If it is not a one-time payment and chooses to pay annually, the annual fee for the current year must be paid in full in the first three months of each year. Otherwise, the patent will become invalid. If the annual fee is doubled in the second quarter, the patent can continue to be valid.
2. Design Patent
After submitting the application documents for an Iranian design patent, it can be authorized for publication after being reviewed by the Iranian Industrial Property Office (IPO).
If everything goes smoothly, the entire process will take about 8-18 months.
When granting design patents in Iran, a fee of 5 years is paid. Renewal can be applied for and the renewal fee paid within 6 months before the expiration date, or up to 6 months after the expiration date. Late fees can also be submitted.
20 years from the date of application
From the date of application, the protection period is 5 years, and can be renewed twice, each time for 5 years, with a maximum protection period of 15 years.
