2. The current trademark regulations are mainly based on the 1981 Trademark Law, which was revised by Act No. 16/2001 of July 26, 2001. The "Office of Company Affairs and Intellectual Property Registration" is responsible for managing trademark affairs, and the official language is English.
3. According to the Barbados Trademark Law, trademark registration is based on the principle of prior application, and the acquisition of trademark rights is based on trademark registration;
4. The Barbados Trademark Law protects goods trademarks, service trademarks, collective trademarks, and color trademarks;
5. Starting from March 12, 1985, Barbados adopted the Nice Agreement on the International Classification of Goods and Services as the trademark registration classification; The trademark system is a single category system.
Due to Barbados not being a member state of Madrid, trademark registration can only be processed through a single method.
The trademark exclusive right is valid for 10 years from the date of approval, and each renewal registration is valid for 10 years. Renewal can be processed one year in advance, with a grace period of 6 months.
1. Provide the name and address of the applying enterprise (in both Chinese and English);
2. Indicate the international classification of goods/services and the designated list of goods/services for use;
3. Clear copy of business license;
4. 5 copies of trademark design, requiring clarity and good paper quality. If it is a color trademark, one black and white draft and five color drafts need to be submitted; The specification shall not be less than 5cm × 5cm, and shall not exceed 10cm × 20cm;
5. If already used, provide the earliest date of use in the registered area when applying.
1. Search for books. Submitting the proposed Barbados trademark name for registration is mainly to avoid being identical or similar to the trademark in the registered trademark application, in order to effectively provide the success rate of trademark registration;
2. Submit the necessary documents for registering a trademark in Barbados;
3. Review. Formal examination: The legality examination of the submitted application documents, trademark designs, power of attorney, and other documents is required after the application is submitted; For those who meet the requirements, the application date and application number will be granted. Substantive examination: Based on the law, examine whether the trademark has registrability, whether it is the same or similar to a previously registered trademark, and whether it violates the prohibition clause of the Trademark Law. For trademarks that fail substantive examination, the examiner will notify the applicant in writing and inform them of the reasons for rejection. The applicant may submit a re examination within the deadline from the date of receiving the rejection notice. Otherwise, the application will be deemed abandoned, and the application date and number will not be retained;
4. Announcement. The trademark that has passed the examination will enter the announcement period, which is 3 months. During this period, anyone can raise objections to the trademark;
5. Register. Trademarks that have no objections or whose objections are not valid during the announcement period will be approved for registration and a certificate will be issued.
