Overview of Bulgarian Trademarks
1. The current trademark regulations in Bulgaria are mainly based on the Trademark and Geographical Indication Law, which came into effect on December 15, 1999. Unified management of trademark affairs by the Bulgarian Patent Office.
2. The official language is Bulgarian.
3. The Bulgarian trademark registration adopts the principle of "prior application", but in some cases, trademark rights can also be claimed through "prior use".
4. Bulgaria adopts the 11th edition of the Nice Classification for product and service descriptions, which can be applied for in one category or multiple categories. The elements that can be registered as trademarks include: textual trademarks, graphic trademarks, three-dimensional logos, color combinations, etc.
5. Any individual, enterprise, or legal entity can register a Bulgarian trademark, but if there is no residence or place of business in Bulgaria, a specialized trademark agency must be designated to handle the registration of a Bulgarian trademark.
Application

Bulgaria is a member of the Madrid System of Trade Agreements (TRIPS); Bulgaria is also a member of the European Union; Therefore, Bulgarian trademarks can be registered through "single country registration" or "EU trademark registration", as well as through "Madrid International Registration".

Validity period and renewal

The Bulgarian trademark is valid for 10 years after registration, starting from the date of application; Renewal can be applied for within 6 months before the expiration date, and the extension period is also 6 months; After renewal, you can regain a validity period of 10 years, and so on.
If a Bulgarian trademark is not actually used locally for five consecutive years after registration, any interested natural person or company may apply to revoke the registered trademark;

Application process

Formality Examination

After the agency submits the Bulgarian trademark registration application to the Bulgarian Trademark Registry, the examiner conducts a legality review of the submitted application documents, trademark drawings, power of attorney, and other documents; Those who meet the requirements will be granted the application date and application number.

substantive examination

The examiner will examine whether the application has registrability, whether it is identical or similar to a previously registered trademark, and whether it violates the prohibition clause of the trademark law in accordance with the Bulgarian trademark law. For Bulgarian trademark registration applications that have not passed substantive examination, the examiner will notify the applicant in writing and inform them of the reasons for rejection. The agency will promptly submit a review after receiving the rejection notice.

After examination, the examiner believes that the Bulgarian trademark registration application can be registered and will be published in the official trademark announcement of Bulgaria, with a 3-month opposition period from the date of announcement.

Bulgarian trademark registration applications that have been ruled invalid or have no objections within the announcement period will be approved for registration and a Bulgarian trademark certificate will be issued.
